DALLAS, TX—
A Union Pacific police agent is on administrative leave after a profanity-laced arrest that was caught on camera by The 33 News.The unidentified railroad agent took a man into custody inside a watery tunnel near downtown Dallas. The agent chased the suspect accused of public intoxication and entered the tunnel with gun drawn.
During the arrest, the agent tells the man to "get on the ground or he would beat his ass". The handcuffed man does not appear to fight back. The agent, who Union Pacific refuses to identify, asks the suspect if he has a gun, saying "you better tell me if you have a gun" at one point threatening, "or I'll kill you".
UP Railroad authorities say they are investigating the incident. They say if the agent violated policy, he will be punished. But, one Latino activist who has seen the questionable arrest says the agent crossed the line. "This is unacceptable", said Carlos Quintanilla. "There is an appropriate way to arrest someone. You don't need to humiliate and demean someone".
The agent can be seen in the video resting his foot on the suspect, who is on the ground. DPS identified the suspect as 18-year old Enrique Franco. He was taken to jail.
But, The 33 News has learned, the investigation may involve a case of stolen identity. Garland high school senior, Rikki Franco, says the suspect is using his name and he wants to know why. "I don't know how he got my identification and my address. I have never seen the dude".
Franco says even though he is mad at the man who allegedly stole his name, he is also angry at the agent who he believes went too far. "I don't know why the officer would do that and say those words".
DPS officials say they are working to identity the suspect in jail.
